Costa Rican Club Challenges FIFA Rules in Club World Cup Dispute

Liga Deportiva Alajuelense takes FIFA to court, seeking entry into the Club World Cup over ownership rule violations.

In a significant blow to the integrity of the upcoming Club World Cup, Liga Deportiva Alajuelense, a renowned club from Costa Rica, has initiated legal action against FIFA at the Court of Arbitration for Sport (CAS).

Alajuelense, boasting a remarkable history with 30 national championships, claims that FIFA has violated its own regulations concerning multi-club ownership. Specifically, they argue that the presence of Mexican clubs León and Pachuca in the tournament contravenes established rules designed to prevent conflicts of interest, given that both clubs are owned by the same entity, the Pachuca Group.

In their complaint, Alajuelense stresses that this joint ownership undermines the fairness and competitive balance of the Club World Cup. They have formally requested that CAS resolve the matter at least one month before the tournament kicks off on June 15 with an expanded format featuring 32 teams. This Court decision could lead to Alajuelense taking the spot of one of the Mexican teams based on their performance and ranking in continental competitions.

According to Article 10.1 of FIFA's regulations for the Club World Cup, it is explicitly stated that no club involved in the tournament can hold or manage another participating club, raising serious questions about the eligibility of León and Pachuca. Alajuelense’s legal journey began in November when they first filed a complaint with FIFA, which acknowledged receipt but did not guarantee Alajuelense's involvement in any subsequent proceedings.

As the situation unfolds, the Pachuca Group has indicated intentions to comply with FIFA's rules by potentially selling a majority stake in León, a move they hope will alleviate the dispute.

Alajuelense remains resolute in their pursuit, having urged FIFA to expedite their decision regarding the case, emphasizing their rightful claim to compete on the global stage alongside football's elite.
